DMCA Policy
The short version
- If your work is here without your permission, email a complete notice and we will take it down.
- The uploader is told and can send a counter-notice if they think it was a mistake.
- Accounts that keep uploading other people's work are closed.
This summary is here to help you read the page. The full text below is what applies.
Where notices go
Designated agent: Misfit Mindset LLC, a Georgia limited liability company, [email protected]. Email is the fastest way to reach us.
Send a notice
If your copyrighted work is on Negative Space without your permission, email [email protected] with the subject "DMCA notice". Include all of the following:
- Your physical or electronic signature. A typed full name works.
- The work you own, described well enough that we can identify it.
- The page URL on this site where it appears, for example
https://negativespace.art/w/…. - Your name, mailing address, telephone number, and email.
- A statement that you believe in good faith that the use is not authorised by the owner, the owner's agent, or the law.
- A statement, under penalty of perjury, that the notice is accurate and that you are the owner or authorised to act for the owner.
A complete notice is how a file comes down. An email missing any of these is not a notice, but we will tell you what is missing.
What happens next
- We remove or disable the wallpaper once the notice is complete.
- We tell the uploader, with a copy of the notice.
- If the uploader sends a valid counter-notice, we forward it to you.
- We restore the file 10 to 14 business days after that, unless you tell us you have filed a court action about it.
Counter-notice
If your wallpaper was removed and you believe that was a mistake or a misidentification, email [email protected] with the subject "DMCA counter-notice". Include:
- Your physical or electronic signature.
- The URL of the wallpaper that was removed.
- A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification.
- Your name, address, telephone number, and email.
- A statement that you consent to the jurisdiction of the federal court for your district, or the Northern District of Georgia if you are outside the United States, and that you will accept service from the person who sent the notice.
Repeat infringement
We close an account that receives more than one valid notice. When a case is plain, we can close it on the first.
Other rights problems
If a wallpaper shows you without your consent, uses your trademark, or breaks the Community Guidelines in another way, use the Report button on its page or email us. These are not DMCA notices. We review them as soon as we can.
Misuse
A false notice or counter-notice can make you liable for damages under the Copyright Act. Send one only if you are the owner, or authorised to act for the owner, and the facts are true.
