Terms of Use

Updated September 28, 2026

The short version

  • You have to be 18 or older.
  • Downloads are free. The license on each wallpaper says what you can do with it.
  • You keep ownership of what you upload. You let us host it, make every size and format from it, and show it on the site.
  • Tips are voluntary and final. Stripe's fee comes off first, then Negative Space keeps 10% and the creator gets the rest.
  • Only upload work you made or have the rights to. We take work down when the owner asks.

This summary is here to help you read the page. The full text below is what applies.

1. The agreement

Negative Space is operated by Misfit Mindset LLC, a Georgia limited liability company ("we", "us"). These Terms of Use, the Fee Schedule, the Refund Policy, the Privacy Policy, the Licensing page, the DMCA Policy, and the Community Guidelines are the whole agreement between you and us. Creating an account, uploading, downloading, or sending money through the site means you accept them. If you do not accept them, do not use the site.

2. Who can use Negative Space

You have to be 18 or older. You confirm that when you join. An account is for one person. Give a real email address you can receive mail at, and keep your password to yourself. You are responsible for what happens under your login.

3. The archive and downloads

Negative Space hosts wallpapers made by its members. Downloads are free. We make each wallpaper in many sizes and formats from the file the creator uploaded. A size bigger than that file is upscaled and labelled as upscaled. The license printed on the wallpaper page is what you get with the download. Nothing on the site sells you a broader license.

We limit how fast one person or address can download, to keep the site up for everyone.

4. Your uploads

You keep ownership of the work you upload.

While the work is on Negative Space, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, resize, crop, upscale, and re-encode it. That covers every download size and format, and the motion loop if you pick one. It also lets us display and distribute the work on the site, in its feeds and API, and in link previews when someone shares its page. Downloaders get the license you picked, not this one.

You also let us show your work, credited to you and linking to it, when we feature it on Negative Space and in posts that promote Negative Space. Examples are Artist of the week, Wallpaper of the day, and a challenge winner. You can ask us to stop featuring a piece at any time. Deleting the wallpaper ends these licenses for anything we post afterwards.

You promise that you made the work or have the rights to upload it, that it does not infringe anyone's rights, and that you are allowed to grant the license you pick. Credit the people you build on. If you used AI tools and the upload form shows the AI-assisted box, tick it.

You can delete a wallpaper from its page at any time. Copies people already downloaded are not pulled back.

5. Licenses on a wallpaper

Each wallpaper is CC BY 4.0, CC0, or free for personal use. The wallpaper page says which one. The Licensing page explains what each one allows. Personal use means you set it as your own wallpaper. You do not republish the file as your own work, and you do not use it in a product you sell. Upscaled sizes and motion loops carry the same license as the original.

6. Adult work

NSFW work stays hidden until you opt in from settings. Nothing on the site guesses. The uploader or a moderator sets the flag. You are responsible for what you upload and for opting in before you look.

7. Tips

A tip is a voluntary payment to a creator. It is not the price of a file. Tips are final and are not refunded. Stripe's fee comes off first. Negative Space keeps 10% of what remains. The creator is paid the rest on the 1st of the month. The amounts, the order of the cut, and the payout date are set out in the Fee Schedule. Tips are final, as the Refund Policy sets out.

Card payments are processed by Stripe. We never see or store your card number. Stripe's own terms apply to the card payment. If you choose to make a tip note public, the creator's page can show it with your name.

8. Supporter contributions

You can make a one-time contribution to Misfit Mindset LLC, a Georgia limited liability company toward running Negative Space through Back the archive. It is not a tip, and no part of it goes to a creator. It buys nothing except a Supporter badge on your page and, if you choose, your name and note on the supporters wall. Contributions are final. The Fee Schedule and Refund Policy cover them.

9. Creator payouts

A creator is paid through a Stripe Connect account that the creator opens. Stripe may ask you for identity and tax details before it pays you. Stripe deposits your share to your bank on the 1st of the month, or on the next business day if the 1st is not a banking day. Details are on the payouts page. Taxes on what you earn are your responsibility.

Sometimes a bank reverses a tip after we have paid you. When that happens, your share of that tip comes out of your next payout. So does the dispute fee Stripe charges us: currently $15.00 for most US card disputes, or whatever fee Stripe actually charges on that dispute. A negative balance carries forward. We do not send a separate bill for it.

10. Challenges and features

We choose which work to feature, such as a challenge winner, Artist of the week, Wallpaper of the day, or Trending. Being featured is not paid. A challenge winner is featured on the homepage when we run that feature. A challenge pays cash only if its page stated a funded prize before that week opened. A caption is not a promise of money.

11. Rules of conduct

Follow the Community Guidelines. In particular, do not:

  • upload work you do not have the rights to, or pass off someone else's work as yours;
  • upload sexual acts, anything sexual or nude involving someone who is or looks like a minor, sexual violence, bestiality, intimate images of a real person without their consent, gore meant to shock, or hate propaganda. Nudity is allowed, marked NSFW;
  • harass, threaten, or impersonate anyone, or post someone's private information;
  • spam comments, mentions, or invite links;
  • use more than one account, or coordinate with others, to push votes, likes, follows, downloads, or the leaderboard;
  • get around the NSFW setting, rate limits, or any other protection;
  • upload malware or anything built to harm a device or the site;
  • scrape the site or the API at a rate that burdens it, or resell the archive.

12. Accounts, moderation, and ending

We can refuse an upload, unpublish or remove a wallpaper, remove a comment, mark work NSFW, or suspend or close an account that breaks these terms. A suspended account can't log in, and its wallpapers may be hidden. Email us to appeal.

Volunteer moderators, listed on /moderators, help handle held uploads and reports on our behalf under a published code. The owner and admins decide suspensions and reports about the team, and every moderation action is logged. Being a moderator is unpaid, doesn't make you our employee or agent for any other purpose, and can end at any time.

Every upload goes through an automatic check that runs on our own server. It can suggest tags and titles, mark nudity NSFW, hold an upload for a moderator before it goes public, or refuse one that is clearly not allowed. The Community Guidelines explain it. A person makes the final call on anything held, and you can ask for a review of an NSFW mark.

You can delete your account from settings at any time. If money is still owed to you, delete the account after it has been paid on the 1st, or email us. The Privacy Policy says what deleting removes and what we keep. Sections 4 (for anything already featured), 7, 9, 13, 14, 15, and 16 survive the end of an account.

13. Copyright

If your work was uploaded without your permission, follow the DMCA Policy. We close the accounts of repeat infringers.

14. The site is provided as it runs

The site and everything on it are provided "as is" and "as available", without warranties of any kind, to the extent the law allows. Wallpapers are the work of other people, or house work with the credits we have. We do not promise that a file is accurate, suitable for a particular use, or available forever. The site can go down. A payout can wait if Stripe has not released the card payment, or if the creator has not finished payout setup.

15. Limits on claims

To the extent the law allows, Negative Space and its operator are not liable for indirect, incidental, special, consequential, or lost-profit damages, or for what a user uploads. Our total liability to you for a claim is the greater of $50 or the fees Negative Space actually kept from your tips in the 12 months before the claim. That limit does not cover creator shares we still owe you under the Fee Schedule. Those are still owed.

You will cover the operator against a claim that arises from your upload, your payment, your breach of these terms, or your misuse of someone else's wallpaper, including reasonable legal costs.

16. Law and disputes

Please email us first. Most problems are fixed faster that way. Georgia law governs these terms, without its conflict-of-law rules. The courts in the State of Georgia are the venue. You can still bring a claim in a place the law says we cannot take away. Nothing here limits a right that cannot legally be limited.

17. Changes to these terms

When we change these terms, the new date goes at the top of this page and the change is listed below. For a change that affects your rights or your money, we will also put a notice on the site. A change to the fee cut never rewrites a tip that already succeeded. If you keep using the site after the new date, you accept the change.
